Advertising Terms and Conditions
For the purpose of these Terms and Conditions, the "Advertiser" shall be defined as the party purchasing advertising services on www.guidetoboston.com (“GTB”) from TotallyJewish.com Limited ("TJ"). The "Advertisement" shall be defined as the textual description provided by the Advertiser, which is designed to promote products, services or visits to the Advertiser's Web Site. A "Visitor" is defined as a user of GTB accessing the site via the Internet to search listings for information. A "Click Through" shall be defined as the event which occurs when a Visitor to GTB activates a link associated with an Advertisement, which causes the Visitor to be delivered to the Advertiser's Web Site which is associated with that Advertisement.
Basis of the Sale
GTB shall sell and the Advertiser shall purchase advertising services in accordance with the published terms of TJ and these conditions shall govern the Contract to the exclusion of any other terms and conditions specified by the Advertiser. Any variation or waiver of these Terms and Conditions can only be by written agreement of both parties.
Upon placing an order with TJ, the Advertiser agrees that TJ has the right to display, transmit and promote the Advertisement provided by the Advertiser on GTB and Visitors to GTB shall have the right to access any material or services linked to the Advertisement.
TJ does not accept responsibility for the accuracy or reliability of the information nor is any kind of warranty or endorsement expressed or implied by such publication on GTB. TJ will not be liable for any errors or omissions in this information or any losses, injuries, or damages arising from its display or use. Any typographical, clerical or other error or omission in any Advertisement published on GTB shall be subject to correction by the Advertiser without any liability on the part of GTB.
Where Advertising is purchased on a fixed term basis, the start and end period is initially reserved but only activated once payment has been received in advance.
Once a payment is made the Advertisement will remain on GTB for one year. Should the Advertiser wish to remove the Advert prior to the expiry of the year, this will not effect the payment - TJ does not provide any refunds any under circumstances.
Right to Refuse or Remove Advertising
TJ at its sole discretion, reserves the right to reject an Advertisement or cease to display it, if it is deemed to be offensive, in violation of advertising standards or in breach of any Warranties provided by the Advertiser under this Contract. In those circumstances TJ reserves the right to terminate this Contract notwithstanding that any Warranties provided hereunder by the Advertiser relating to the transmission and promotion of the Advertisement shall stay in force.
Advertising which relates to Adult Content will not be accepted. Any Advertisement shall not be accepted if it contains nudity, profane language or is otherwise deemed by TJ to be offensive. Any link to a site containing Adult Content from an Advertisement will be deleted.
Advertiser's Warranties
TJ shall not be liable to the Advertiser by reason of any representation or any implied warranty, condition or other term, or any duty at common law or under the express terms of the contract, for any consequential loss or damage (whether for loss of profit or otherwise) costs expenses or other claims for consequential compensation whatsoever and whether caused by the negligence of TJ, its employees or agents or otherwise which arise out of or in connection with the supply of Advertising Services or their use or resale by the Client, except as expressly provided in these conditions.
By placing an order for Advertising Services with TJ, the Advertiser warrants that the Advertiser is wholly responsible for any legal liability relating to the Advertisement or the Web content that it links to and the consequences of its transmission or promotion by TJ on GTB; the Advertisement does not contain or link to any offensive or pornographic content; the transmission or the distribution of the Advertisement and the content which it links to does not infringe any copyright, trademark, intellectual property right or violate the privacy of any individual or breach advertising standards or violate any Laws in any Country or Jurisdiction where the Advertisement can be accessed. The Advertiser further indemnifies TJ against any claims, loss, damages, or legal expenses or other expenses in connection with any claims arising from a breach of these warranties.
